Joint Prakas on the Strengthening the Foreign Manpower Inspection in Cambodia

On 10 March 2016, the Ministry of Labor and Vocational Training (MoLVT) and Ministry of Interior issued a Joint Prakas No. 2703 on Strengthening the Foreign Manpower Inspection in Cambodia. The main points of the Prakas include:

  • Any enterprise/institution which employs foreign employees or any foreigner who comes to operate any business in Cambodia shall abide by the Law on Immigration and the Labor Law of Cambodia. No foreigner can operate any business in Cambodia without the work permit and employment card issued by the MoLVT;
  • When the inspection is conducted, owners or directors of enterprises/institutions shall cooperate with the Foreign Manpower Inspection Joint Group to show necessary documents detailed in the Joint Prakas;
  • Foreigners who operate a small-scale business, secondary business, mobile business or night business shall hold a business authorization letter issued by the competent authorities in order to complete the formalities for issuance of work permit and employment card;
  • Any owner or director of an enterprise/institution who employs foreign workers or any foreigner operates business without work permit and employment card, shall be subject to fine and penalty in accordance with the provisions of Chapter 16 of the Labor Law and the provisions of Chapter 5, and expulsion in Chapter 6 of the Law on Immigration;
  • Only the Foreign Manpower Inspection Joint Group has duties to conduct a foreign manpower inspection by using the joint assignment letter issued by the General Department of Immigration and the General Department of Labor.
