We are pleased to invite you to the upcoming webinar on the "New Regulations on E-Commerce in Cambodia" organized by the Ministry of Commerce ("MOC") and the Asian Development Bank (“ADB”) in association with EuroCham Cambodia, on Friday 25 June 2021, at 9:00 AM via Zoom Webinar.

The E-Commerce Law came into force on 2 November 2019, followed by implementing regulations in late 2020. Sub-Decree 134 on 27 August 2020 and Prakas 290 on 9 October 2020 gave guidelines on the scope of this new law, the types of activities covered and the kinds of companies, organizations or individuals that would be governed by its provisions, license and permit requirements. These developments have raised concerns and questions among many E-Commerce operators (large or small) on how to be compliant.

In this webinar, our experts will go through the main points of the E-Commerce Law and its implementing regulations, letting you know what the key compliance points are, the types of entities or E-Commerce activities most affected and what swift action is needed now to avoid fines and unnecessary penalties in the future.

H.E  Mr. SOK Sopheak, Secretary of State at Ministry of Commerce

Since November 10, 2018, H.E. Mr. Sok Sopheak has been nominated by the Royal Government of Cambodia as Secretary of State of Ministry of Commerce (MoC), following his two-year assignment as an Under Secretary of State since early 2016. He took main charge of the General Directorate for Trade Support Services and the General Directorate for International Trade.

H.E. Mr. SOK Sopheak holds Bachelor’s Degree in Economics from the Faculty of Business in Cambodia in 1992 and Master’s Degree in Economics and Finance from the School of Orientation for African Study of the University of London, UK in 1997. He also earned another Master’s Degree in Public Policy from Saitama University, Japan in 2000.

Prior to his occupation at MoC earliest in 1992, he had served for the Provincial Government of Cambodia as Director of Electricity Power Plant Authority of Koh Kong Province since 1986. At MoC, he was promoted as Director of ASEAN and International Organizations Department in 1999 after which he has assumed many key roles as, among others, trade negotiator for Cambodia’s integration into ASEAN, ASEAN Plus-One FTAs, and the World Trade Organization (WTO).

He was promoted as Director General of International Trade, MoC in 2007 and moved to work as Director General of the General Directorate for Trade Support Services in 2014, where he has been promoting the implementation of trade reform agenda and trade facilitation, including but not limited to, development of online business registration, certification of origin, and online trademarks applications, etc.

HE Mr. Sok Sopheak was Cambodia’s Trade Negotiation Committee (TNC) lead in trade negotiations on Regional Comprehensive Economic Partnership (RCEP) which was signed on November 15, 2020. He was also Cambodia’s lead negotiator for the Cambodia-China Free Trade Agreement (CCFTA) which was signed on October 12, 2020. Moreover, he was also the lead of drafting teams of Law on Trade Remedy and Law on E-commerce which have come into force since 2017 and 2019, respectively.

 

H.E. Mr. OM Dararith, Advisor to Ministry of Commerce and Director at Business Registration Department

Since 2014, H.E. Mr. OM Dararith has been nominated by the Royal Government of Cambodia as Director of Business Registration Department, Ministry of Commerce. His main role is to lead the department of Business Registration which responsible for all the mater related to the company law.

H.E. Mr. OM Dararith holds Bachelor’s Degree in Economics from the Institute of economic in Cambodia in 1993 and Master’s Degree in Public Policy from Saitama University, Japan in 1998.

He started his career at the Ministry of Commerce since 1994 and Promoted as chief of office in Department of Legal affairs. In 2007, he was promoted as Director of the Department of Legal affairs in the Ministry of Commerce in which he participated in drafting the business laws including Commercial enterprises law, Company law, Secure transaction law, Bankruptcy law and Ecommerce law. Until 2014 to present, he was appointed as Director of Business Registration which hold a crucial role in develop the online business registration which is put into practice nowadays.

 

Mr. Matthew TIPPETTS, Chairman at EuroCham ICT Committee

Matthew is an experienced global entrepreneur, with over 20 years of experience in TMT, first as an investment banker, having worked Robertson Stephens and having done over 30 transactions (IPOs, private placements, M&A). As a hedge fund analyst, having worked for Citadel, the $30bn multi-strategy fund and finally as an advisor. He has extensive knowledge in both developed and emerging markets, especially in emerging markets such as Cambodia and Myanmar. ​

He is a Magna Cum Laude alumni of Babson College in the USA, and graduated with an MBA from INSEAD.

 

Mr. Chris McCarthy, CEO at MangoTango Asia

Chris McCarthy is CEO of MangoTango Asia, a consulting and marketing services company that uses creativity, technology, data and digital media to build value for clients around the world, including Accenture, Google, SAP and Heineken. He has held leaderships roles on ICT Committees at the European and American Chambers of Commerce in Cambodia, providing input to the Royal Government of Cambodia on legislation for eCommerce, data privacy, and cybersecurity.

He is the founder of seven technology startup companies from Silicon Valley to New York City and Singapore, raising more than $50 million in venture funding; all were acquired and one had an IPO on the NASDAQ public market; the latest company is growing quickly.

 

Ms. SRENG Nearirath, DFDL Legal Expert and ADB Consultant 

Nearirath SRENG is a DFDL Legal Expert and ADB Consultant. She has 11 years of experience in legal practice. Throughout her career, she mainly advises both international and national banks, capital markets intermediaries, insurance companies, FinTech, E-Commerce, Telecom and other financial institutions on financial services compliance and regulatory matters, and works closely with her clients to her clients with innovative solutions when it comes to complex regulatory issues related to these matters. She has significant experience in both legal and compliance on regulatory matters, particularly in both financial and technology including payment gateway, e-wallets, digitalisation and tokenization, cloud, satellite and so forth. She has been also involved in the drafting regulations on E-Commerce and consumer protection.

 

Moderator - Mr. Simon BURLINSON, Senior Consultant at DFDL

Simon Burlinson is currently working as a Senior Consultant under the Cambodian Corporate and Commercial Practice Group of DFDL Cambodia. His areas of expertise extend to pharmaceutical and healthcare law, intellectual property law, cross-border corporate transactions, banking and advising multinationals on their foreign direct investment in Cambodia (including entity incorporation, commercial agreements and corporate structuring). He is also a qualified English solicitor. He holds a Graduate Diploma in Law (Holborn BPP, London, UK), a MSc. in Management of Intellectual Property (Queen Mary’s College, London, UK), and a BSc. in Pharmacology and Toxicology (King’s College, London, UK). He speaks English, French, and Khmer.
